Privacy policy
How we handle your personal data, what we use it for and what rights you have over it. Provided under articles 13 and 14 of Regulation (EU) 2016/679 (GDPR).

What data we handle and where it comes from
We only handle the data you give us voluntarily through the contact form: name, email address and, if you choose to provide them, phone number and garden location, together with the service you are interested in and the message you write.
We do not collect data from external sources, we do not build profiles and we do not make automated decisions with legal effects.
We do not ask for special categories of data (health, beliefs, religion and the like). Please do not include them in your message.
What we use it for, and on what legal basis
- Answering your enquiry and preparing a quotation
- Legal basis: pre-contractual steps taken at your request (art. 6.1.b GDPR) and your consent given by ticking the form checkbox (art. 6.1.a GDPR).
- Preventing automated submissions and form abuse
- Legal basis: legitimate interest in protecting the service against fraudulent use (art. 6.1.f GDPR).
- Meeting legal obligations where a contract exists
- Legal basis: compliance with a legal obligation (art. 6.1.c GDPR).
- Measuring website use
- Legal basis: your consent, given in the cookie notice and withdrawable at any time (art. 6.1.a GDPR). Without it, no measurement tool is loaded.
How long we keep it
If your enquiry does not lead to a contract, we keep the message for a maximum of twelve months from the last contact, and then delete it.
If a contractual relationship does arise, we keep the data for the duration of that relationship and then, blocked, for the statutory limitation periods applicable under tax, commercial and civil law.
Who else has access
We do not sell or transfer your data to third parties for their own purposes. Some providers do act as processors, under a contract signed in accordance with article 28 GDPR:
- Google Ireland Ltd. (Google Analytics)
- Only if you accept measurement. Receives pages visited, device and browser, with the IP anonymised. May process data outside the EEA under the standard contractual clauses.
Where a provider processes data outside the European Economic Area, the transfer relies on the standard contractual clauses approved by the European Commission or on an adequacy decision.
We may also disclose data to courts, tribunals and public authorities where legally required.
Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability by writing to vjardiners@gmail.com, stating the right you are exercising and attaching a copy of a document proving your identity.
Where processing is based on your consent, you can withdraw it at any time, without affecting the lawfulness of processing carried out beforehand.
If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es), C/ Jorge Juan 6, 28001 Madrid.
Security
We apply technical and organisational measures appropriate to the risk: an encrypted HTTPS connection across the whole site, restricted access to messages received, and mail credentials stored outside the published code.
